A guardianship is a court-supervised proceeding for a minor under the age of 18 or an incapacitated adult. There are two types of guardianships: a guardian over the person and a guardian over the estate. Sometimes, only one type of guardianship is needed, but in other cases both types of guardianships are necessary. The person appointed by the court as guardian has the duty to provide the necessary care to the ward, the person for whom guardianship is initiated.

In Texas, the guardianship process involves the following steps:

  • If the person is not a minor, you have to prove their incapacity with a doctor’s certificate.
  • You must file a certificate of guardianship. This must be filled out within 120 days of the guardianship application.
  • An attorney ad litem will be assigned to the child or incapacitated person to ensure their rights are protected.
  • If everything is approved, Letters of Guardianship will be issued.
  • If you wish to retain guardianship, you will need to renew your Letters of Guardianship in 16 months.
