Skilled Guidance for the Estate Administration Process
Most individuals leave behind an estate when they die. An estate comprises the individual's real property, personal possessions, bank accounts, investments, vehicles, business ownership interests and other valuables. An estate of a deceased individual must be administered within four years of the date of the individual's death.

What Is Estate Administration?
Estate administration, also referred to as probate, includes the court procedure for confirming a deceased individual's will is valid, and appointing the personal representative of an estate (referred to as an executor or administrator) and facilitating payment of debts and distribution of property to the beneficiaries of a will. The appointed executor must meet specific criteria to serve and must follow certain rules and laws while he/she carries out his/her duties.
Estate administration allows for:
- Appointment of an estate representative
- Distribution of assets to beneficiaries and heirs
- Transfer title to real estate
- Payment of debts
- Charitable distributions
The administration of an estate is often independent, which means that the executor has the autonomy to administer the estate and carry out the terms of the will without court intervention or supervision. Under certain circumstances, a dependent administration may be used. An executor for a dependent administration has all of the same duties and obligations as an executor under an independent administration, except the dependent executor is subject to court intervention and supervision.
Estate administrations are not limited to situations where an individual dies with a will in place. If a deceased individual did not have a will in place, his/her estate will still require administration after an heirship proceeding has taken place.
